This document describes A) the terms of sale for products on the site, B) those for custom paintings, and C) those for illustrations in the fields of publishing, concept art, etc.

​A) General Terms and Conditions of Sale for the online shop

​1. Preamble

​These general terms and conditions of sale govern the contractual relationship between Marie L., owner of the site arbredelanuit.fr, and any person making a purchase on the site.

​2. Products

​2.1. The original paintings offered for sale are described and presented with the greatest possible accuracy. However, variations in colors and details may occur due to differences in screen displays.

2.2. Product prices are indicated in euros. Delivery costs are included for small formats / light shipments internationally; for France, regardless of the format, all shipping costs are included.

​3. Orders

​3.1. To place an order, the buyer must follow the online ordering process and provide the required information.

3.2. Once the order is placed, a confirmation email will be sent to the buyer, summarizing the order details.

3.3. The seller reserves the right to refuse any order in the event of a dispute with the buyer, a previous payment problem, or for any other legitimate reason.

​4. Price and Payment

​4.1. Product prices are those indicated on the site at the time of the order. Prices are subject to change over time on the site without prior notice.

4.2. Payments can be made using the payment methods accepted on the site at the time of the order (Credit Card, Stripe, PayPal, etc.).

​5. Delivery

​5.1. Delivery costs (except for France and small formats) are the responsibility of the buyer and vary according to the destination and weight of the products.

5.2. Orders are shipped within 2 to 5 business days. Delivery times are generally estimated between 2 and 5 business days and may vary depending on the destination and transport conditions (1 to 2 weeks for the USA). The seller will endeavor to meet these deadlines but cannot be held responsible for delays beyond their control.

5.3. The delivery methods offered on the site are registered mail or registered parcels depending on the weight and have a tracking number (to be entered on https://www.laposte.fr); Note: the "ad valorem" option from La Poste is automatically included in the prices to protect your package in case of loss. It is possible that the tracking number may not work in certain countries. Extract from the conditions of La Poste.fr:

Registered mail is tracked from end to end for 35 destinations: Albania, Austria, Belgium, Canada, Czech Republic, Denmark, Estonia, Finland, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Korea, Latvia, Lithuania, Luxembourg, Malaysia, Mali, Malta, Mexico, Morocco, Netherlands, Norway, Poland, Portugal, Qatar, Romania, Serbia, Singapore, Slovakia, Slovenia, Spain, Sweden, Switzerland, Thailand, Togo, Turkey, United Kingdom, USA (non-exhaustive list subject to change during the year).

For other countries:

La Poste ensures the transport of items to the border. Beyond that, the items are handled by and under the responsibility of the local operator, on whom the scanning at delivery depends. Sending by registered mail ensures your order in most cases.

5.4. The seller cannot be held responsible for any damage caused during transport by postal services (La Poste or any other carrier depending on the destination country), or for the loss of the package. However, if you notice a problem upon receipt, please do not open the package and contact the delivery company as soon as possible to file a claim; please also contact the seller so they can relay the information to the delivery company on their end and proceed with a refund if La Poste's conditions allow.

​6. Right of Withdrawal

​6.1. In accordance with current legislation, the buyer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

6.2. To exercise this right, the buyer must inform the seller in writing (marie@arbredelanuit.fr) and return the product in its original condition, accompanied by all accessories. Return shipping costs are the responsibility of the buyer; in case of loss of the return package, it will not be refunded. Please return the package via a post office only, no relay points.

6.3. Only the price of an item returned in new condition will be refunded. Custom orders made according to the buyer's specifications are not covered by the right of withdrawal, in accordance with Article L.121-20-2 of the Consumer Code. They cannot, therefore, be subject to a refund request.

​7. Intellectual Property

​7.1. The illustrations and paintings sold, as well as the photos and music on the site, remain the intellectual property of Marie Lagrange.

7.2. Any reproduction, use, or distribution of the products for commercial or personal purposes is prohibited without the prior authorization of Marie Lagrange and will be considered an act of infringement and prosecuted in accordance with the provisions of Articles L.335-2 and following of the Intellectual Property Code.

​8. Disputes

​8.1. In the event of a dispute, the parties will endeavor to reach an amicable settlement. Failing that, the competent courts will be seized.

​B) Terms of Sale for the creation of custom paintings

​1. Purpose

​These terms of sale govern the methods of creation and purchase of "custom paintings" offered by Marie Lagrange (the "Creator") via the website arbredelanuit.fr / marie@arbredelanuit.fr.

​2. Order and Creation Process

​2.1. The ordering process for custom paintings begins with a request for a quote from the client.

2.2. The client must provide details regarding the project, including, if possible, dimensions, subject, preferred colors, and any other relevant information.

2.3. The Creator will provide a detailed quote to the client, including the total price, estimated deadlines, and any special conditions.

2.4. The order will be confirmed only after the client's written acceptance of the quote and the payment of a 30% to 50% deposit of the total price, depending on the type of project.

​3. Price and Payment

​3.1. The total price of the custom painting is fixed in accordance with the quote provided by the Creator.

3.2. The payment of the deposit can be made using the payment methods accepted by the Creator (Paypal, bank transfer, check handed over in person). The remaining balance will be due just before the painting is shipped.

​4. Realization and Deadlines

​4.1. The Creator agrees to produce the custom painting in accordance with the specifications agreed upon with the client.

4.2. The production deadlines will be indicated in the quote. However, delays may occur due to circumstances beyond the Creator's control.

​5. Approval and Modifications

​5.1. The Creator will provide the client with a preparatory sketch or a photo of the painting in progress for approval if this is part of the client's request.

5.2. During the approval phases, the client may request modifications during the sketch stages and at the beginning of the final painting, subject to mutual agreement on the adjustments and their possible impact on deadlines and price.

​6. Delivery

​6.1. Once the painting is finished and the final balance of the payment is received, the Creator will proceed with the shipment according to the agreed methods.

6.2. Delivery costs will be borne by the client and included in the total price.

​7. Intellectual Property

​7.1. The Seller retains the intellectual property rights to the custom painting, unless otherwise agreed.

​8. Cancellation

​8.1. In the event of cancellation of the order by the client after production has begun, the deposit paid will not be refunded due to the personalized nature of the painting.

8.2. In the event of cancellation of the order by the Creator for reasons beyond their control, the deposit will be refunded to the client.

​9. Disputes

​9.1. In the event of a dispute, the parties will endeavor to reach an amicable settlement. Failing that, the competent courts will be seized.

​C) Terms of Sale for the creation of illustrations for publishing, advertising, and concept art

​1. Purpose

​These terms of sale define the methods of creation and purchase of illustrations (the "Works") offered by Marie Lagrange (the "Creator") for use in the fields of publishing, advertising, concept art, etc.

​2. Order and Creation Process

​2.1. The client must submit a request for a quote to the Creator, providing full details of the project, technical specifications, format, purpose of the illustration, deadlines, and any other relevant elements.

2.2. The Creator will provide a detailed quote to the client, including the total price, estimated deadlines, and all special conditions.

2.3. The order will be confirmed only after the client's written acceptance of the quote and the payment of a 30% to 50% deposit of the total price, depending on the type of project.

​3. Price and Payment

​3.1. The total price of the Work is defined in the quote provided by the Creator.

3.2. The payment of the deposit can be made using the payment methods accepted by the Creator. The remaining balance will be due just before the final Work is delivered.

​4. Realization and Approval

​4.1. The Creator agrees to produce the Work in accordance with the specifications agreed upon with the client.

4.2. The Creator will provide the client with samples or sketches for approval as the creation progresses.

4.3. During the approval phases, the client may request modifications during the sketch stages and at the beginning of the final painting, subject to mutual agreement on the adjustments and their possible impact on deadlines and price.

​5. Delivery and Rights of Use

​5.1. Once the Work is completed and full payment is received, the Creator will provide the Work to the client according to the agreed methods.

5.2. The rights of use for the Work will be defined in a separate contract, specifying the authorized areas of use and any limitations.

​6. Intellectual Property

​6.1. The Creator retains the copyright and intellectual property rights to the Work, unless otherwise agreed and according to the copyright contract.

​7. Cancellation

​7.1. In the event of cancellation of the order by the client after production has begun, the deposit paid will not be refunded due to the personalized nature of the Work.

7.2. In the event of cancellation of the order by the Creator for reasons beyond their control, the deposit will be refunded to the client.

​8. Disputes

​8.1. In the event of a dispute, the parties will endeavor to reach an amicable settlement. Failing that, the competent courts will be seized.
